Easiest thing to do is e-mail the website administrator and ask him/her if they will give you permission to use it.  Generally, if a pic is something that the general public could get (ie, a pic they could take, is one of Microsoft's many photos, etc) then you can use it without a problem, but it never hurts to just go to the source and ask permission.  Then you're covered either way.
